Acceptance of Terms
These Terms of Service govern your use of Canvas & Clay and its services. By accessing and using our website, participating in our workshops, and engaging with our community art sessions, you agree to be bound by these terms. We provide a platform for creative self-expression through watercolour, pottery, collage, and other artistic mediums in Irish centres and libraries. If you do not agree with any part of these terms, you may not use our services. We reserve the right to modify these terms at any time, and your continued use of our platform constitutes acceptance of any changes.
User Obligations
As a user of our workshops and community art sessions, you agree to comply with all applicable laws and regulations. You are responsible for maintaining the confidentiality of any account information and for all activities that occur under your account. We expect all participants to treat fellow artists and our staff with respect and courtesy during all sessions. You agree not to engage in harassment, discrimination, or any disruptive behaviour. You must not attempt to damage, disable, or impair our website or services. Additionally, you agree not to share harmful content, promote unsafe artistic practices, or violate the intellectual property rights of others during your participation in our creative community.
Intellectual Property Rights
All content on our website, including artwork, photographs, descriptions, and educational materials about watercolour, pottery, and collage techniques, is protected by copyright and intellectual property laws. We retain full ownership of all original materials, workshop designs, and artistic guidance provided through our platform. However, artwork created by individual participants during our sessions belongs to the artist who created it. You may not reproduce, distribute, or commercially exploit any of our original content without express written permission. We encourage artistic exploration and personal reflection, and you retain rights to your own creative work developed through our workshops and community sessions.
Limitation of Liability
We provide our workshops, website, and community art sessions on an “as is” basis without warranties of any kind. We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of our services, including stress relief outcomes or artistic discoveries. While we strive to ensure safe and supportive environments for creative exploration, we cannot guarantee specific results or therapeutic benefits. Participants engage in artistic activities at their own risk. We are not responsible for loss of personal items, injury during workshops, or any issues arising from creative practice. To the maximum extent permitted by law, our total liability shall not exceed the amount you paid for our services.
Termination of Services
We reserve the right to terminate or suspend your access to our workshops, website, and community art sessions at any time, with or without cause. Termination may occur if you violate these terms, engage in misconduct during sessions, or pose a risk to other participants. Upon termination, your right to use our services ceases immediately. We may also discontinue specific workshops, community sessions, or features at our discretion. If we terminate your access, you will be notified and provided with information about any outstanding matters. Sections regarding intellectual property, limitation of liability, and indemnification shall survive any termination of your use of our services.
General Provisions
These Terms of Service constitute the entire agreement between you and us regarding your use of our workshops and services. If any provision is found to be unenforceable, the remaining provisions shall continue in effect. Your failure to enforce any right does not constitute a waiver of that right. You agree not to assign these terms without our consent. We may assign our rights and obligations to any third party. These terms are governed by and construed in accordance with Irish law. Any legal action or proceeding relating to these terms shall be brought exclusively in the courts of Ireland.
